Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Fortune Market platform, which is a project of Artyologers, a business registered in Sri Lanka ("Fortune Market", "we", "us", or "our"). By accessing or using the Fortune Market website, mobile application, or any related services, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations.

If you do not agree to these Terms, you must not use the platform. All rights reserved to Artyologers.

In these Terms, the following terms have the meanings set out below:

• Platform: the Fortune Market website and any related services operated by Artyologers.
• Buyer: a user who purchases products through the platform.
• Producer: a registered user who lists and sells products through the platform.
• Admin: a user authorised by Fortune Market to administer the platform.
• Listing: a product or service offered for sale by a Producer on the platform.
• Order: a confirmed purchase request placed by a Buyer for one or more Listings.
• Offer: a time-limited promotional discount applied to a Listing.

To use the platform, you must be at least 18 years old and capable of entering into a binding contract. By creating an account, you confirm that the information you provide (including your name, email, phone number, and any address) is accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account. Registration may require phone number verification through a one-time password (OTP).

Producers must complete our onboarding process and obtain approval before listing products. Approval is at the discretion of Fortune Market and may be withdrawn at any time.

Each Producer is solely responsible for the accuracy and lawfulness of their Listings, including the product name, description, price, stock levels, unit, and images. Producers must not list prohibited or unlawful goods and must ensure their products comply with all applicable Sri Lankan laws and regulations.

Fortune Market may remove, disable, or correct any Listing that we consider inaccurate, misleading, or non-compliant with these Terms.

All prices on the platform are displayed in Sri Lankan Rupees (Rs.). Orders may be paid by Cash on Delivery or card payment, where available. You agree to pay the total amount shown at checkout, including any applicable fees.

Once placed, an Order follows a status lifecycle of Pending → Confirmed → Processing → Shipped → Delivered, or Cancelled. Delivery is arranged between the Buyer and the Producer. Fortune Market is a marketplace platform and is not itself a courier or delivery service; delivery times and methods depend on the Producer.

Cancellation, return, and refund eligibility depend on the status of the Order and the relevant Producer's policies. Where a refund is due, refunds for card payments will be processed to the original payment method, and refunds for Cash on Delivery orders may require alternative arrangements.

If a dispute arises in relation to an Order, we may facilitate communication between the Buyer and Producer and will resolve the matter in accordance with these Terms and any applicable consumer protection laws.

Fortune Market may apply a category markup or commission to Producer Listings for the use of the platform. Any such fees will be shown or communicated to Producers before they take effect. Fortune Market reserves the right to introduce, adjust, or remove fees at any time, with reasonable notice where practicable.

From time to time, Fortune Market and Producers may run time-limited Offers with discounted prices. The price displayed during the Offer window reflects the applicable discount. Offers are subject to availability and, where applicable, admin approval. Fortune Market reserves the right to modify or withdraw any Offer at any time.

Only verified Buyers who have purchased a product may leave a review. You agree not to post reviews that are false, misleading, abusive, or unrelated to the product. Fortune Market may remove any review that we consider to breach these Terms.

You agree not to use the platform to:

• List or sell any unlawful, counterfeit, or prohibited goods;
• Engage in fraud, misrepresentation, or deceptive practices;
• Submit false, misleading, or duplicate Listings;
• Misuse the reporting or review systems;
• Infringe the intellectual property rights of others;
• Harass, abuse, or harm other users; or
• Attempt to gain unauthorised access to the platform or its systems.

Fortune Market provides tools to report Listings, reviews, or other content that you believe violates these Terms or applicable law. Fortune Market (on behalf of Artyologers) reserves the right, in its sole discretion, to remove Listings, reject Offers, moderate content, and suspend or terminate any account that breaches these Terms.

All platform content, software, branding, logos, and design ("Platform IP") are the property of Artyologers and are protected by applicable intellectual property laws. All rights reserved to Artyologers. You may not copy, reproduce, distribute, or create derivative works from Platform IP without our prior written consent.

Producers retain ownership of their own product content. By uploading content, Producers grant Fortune Market a non-exclusive, worldwide, royalty-free licence to display, host, and distribute that content on the platform.

Fortune Market acts as an intermediary between Buyers and Producers. To the maximum extent permitted by law, Fortune Market and Artyologers shall not be liable for any indirect, incidental, or consequential damages, or for any loss arising from the actions, omissions, or products of individual Producers. Nothing in these Terms limits any liability that cannot be limited under Sri Lankan law.

Product descriptions, images, and other Listing details are provided by Producers and are not independently guaranteed by Fortune Market. While we work to maintain accurate information, we do not warrant that all Listing information is complete, current, or error-free.

Fortune Market may suspend or terminate your access to the platform, in whole or in part, at any time and for any reason, including if you breach these Terms. Upon termination, your right to use the platform ceases immediately, subject to the completion of any outstanding Orders.

Fortune Market may update these Terms from time to time. We will post any changes on this page. Your continued use of the platform after the changes take effect constitutes your acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising out of or relating to these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
